NOTICE IS HEREBY GIVEN that at its meeting held on April 24, 2019, the Placer County Airport Land Use Commission (ALUC) continued the public hearing to May 22, 2019 at 3:00 pm or soon thereafter to consider an appeal submitted by the applicant, Beacon Development LLC, regarding the ALUC Executive Secretary’s determination that the proposed Verizon Cell Tower Minor Use Permit Modification is inconsistent with the Placer County Airport Land Use Compatibility Plan.
The applicant, Beacon Development LLC, is proposing to extend the height of an existing cell tower from an existing top of elevation of 41 feet to 63 feet 2 inches. In addition, the applicant proposes to add 12 antennas, a generator, three remote radio units, six power lines, three fiber lines and three squids to the existing cell tower. The project is located at 12393 Shale Ridge Road on a 2,310 sq. ft. site (APN: 076-470-024-000) located in the North Auburn community. The project requires approval of a Minor Use Permit Modification from Placer County.
The proposed project is in the Auburn Municipal Airport Land Use Compatibility Zone B2 and a Height Review Overlay Zone. Under the Placer County Airport Land Use Compatibility Plan, communication facilities, including cell towers, are prohibited in Compatibility Zone B2. The proposal is therefore considered inconsistent with Plan’s safety and airspace protection provisions if located within Compatibility Zone B2.
The applicant’s appeal request includes a Federal Aviation Administration (FAA) “Determination of No Hazard to Air Navigation” aeronautical study, which revealed that while the proposed cell tower height would exceed obstruction standards, it would not be considered a hazard to air navigation subject to FAA conditions. The applicant also asserts that Federal Communication Commission regulation preempts from local land use control certain wireless facilities and that their proposal to modify the existing cell tower falls within these provisions, which exempts from local control modifications which are not substantial changes to existing facilities.
The Placer County ALUC Rules of Procedure require that an appeal of a determination of land use consistency or inconsistency be heard by public hearing. The public hearing will be held on:
